By using our website and services, you agree to the following terms and conditions.

1. Agreement to Terms

By accessing or using the Donate website (donate-foundation.org), you agree to be bound by these Terms of Use. If you do not agree, please do not use the site.

2. Description of Service

  • Donate ALS Foundation operates Donate, which connects donors with verified nonprofit organizations focused on women and children
  • Donate ALS Foundation is a nonprofit public benefit corporation, EIN 41-4482858, operating for charitable purposes
  • The organization serves as an intermediary: it verifies partner organizations, facilitates donations, and provides the communication infrastructure for donors and partners to connect
  • Donate ALS Foundation does not guarantee the outcomes of any specific campaign or the performance of any partner organization

3. Permitted Use

The site is intended for:

  • Browsing verified nonprofit organizations
  • Making charitable donations to partner organizations
  • Applying to join as an NGO partner
  • Learning about Donate ALS Foundation’s work

4. Prohibited Conduct

The following activities are strictly prohibited:

  • Fraudulent activity
  • Impersonation of NGO partners
  • Unauthorized data collection (scraping, crawling)
  • Harmful content
  • Misuse by NGO partners (false information, misrepresentation)
  • Interference with site operations
  • Violation of applicable law

5. Intellectual Property

Donate ALS Foundation content: Name, logo, site design, original text are property of Donate ALS Foundation.

Partner organization content: Campaign descriptions, impact reports, photos remain the intellectual property of those organizations.

User-submitted content: Submitted with a non-exclusive license to Donate ALS Foundation for platform operation.

6. Financial Transactions

All donations are processed securely through Stripe. Donate ALS Foundation facilitates the transaction between donors and partner organizations. Please review the terms of any specific campaign before donating.

7. Limitation of Liability

Donate ALS Foundation provides this site and its services on an "as is" basis. We make no warranties, express or implied, regarding the site's operation or the information, content, or materials included. To the fullest extent permitted by law, Donate ALS Foundation shall not be liable for any damages arising from your use of the site.

8. Indemnification

You agree to indemnify and hold harmless Donate ALS Foundation, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the site or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Mateo County, California.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the site after changes constitutes acceptance of the revised Terms.

11. Acceptable Use and Prohibited Uses Policy

This Acceptable Use and Prohibited Uses Policy applies to all users of the Donate website, platform, services, donation pages, nonprofit profiles, fundraising campaigns, content submissions, and any other use of Donate ALS Foundation's services.

Donate ALS Foundation is committed to operating a safe, lawful, transparent, and compliant charitable fundraising platform. Users may not use Donate, directly or indirectly, for any purpose, organization, campaign, content, product, service, transaction, or activity that violates applicable law, these Terms, Donate ALS Foundation's nonprofit eligibility standards, Stripe's Prohibited and Restricted Businesses List, card network rules, sanctions laws, anti-money laundering rules, or any requirements of our payment processors, banking partners, or financial service providers.

11.1 Compliance with Stripe and Payment Processor Requirements

All donations and related transactions on Donate are processed through third-party payment processors, including Stripe. By using Donate, you agree that you will not use the platform in any way that is prohibited or restricted by Stripe's Prohibited and Restricted Businesses List or by any applicable payment processor rules.

Donate may reject, suspend, remove, or restrict any organization, campaign, donation, payout, content, or account if we believe, in our sole discretion, that it may violate Stripe's requirements, payment processor rules, applicable law, these Terms, or our compliance standards.

If Stripe or another payment processor requires additional due diligence, approval, documentation, account review, transaction review, reserve, delay, refund, suspension, or termination, Donate may take any action necessary to comply.

11.2 Prohibited Uses

You may not use Donate to create, promote, fund, support, facilitate, process, or receive donations for any prohibited purpose, including but not limited to:

  • Illegal activity. Any activity, organization, campaign, product, service, content, or transaction that is illegal in any applicable jurisdiction, or that supports, encourages, promotes, or facilitates illegal activity.
  • Fraud, deception, or misrepresentation. Any false, misleading, deceptive, unfair, predatory, or abusive activity, including fake organizations, fake campaigns, false impact claims, impersonation, misleading donor communications, deceptive fundraising statements, fabricated beneficiaries, fraudulent documentation, or unauthorized use of another organization’s name, brand, content, or identity.
  • Sanctions and high-risk persons or jurisdictions. Any activity involving, benefiting, or supporting sanctioned persons, restricted persons, embargoed jurisdictions, high-risk jurisdictions, or any person or entity prohibited or restricted under sanctions laws or by Stripe, including restrictions maintained by the United States, United Kingdom, European Union, United Nations, OFAC, or other applicable authorities.
  • Violence, hate, harassment, or exploitation. Any organization, campaign, content, or activity that promotes, celebrates, funds, supports, or facilitates unlawful violence, physical harm, terrorism, extremist activity, hate, harassment, threats, abuse, exploitation, or discrimination based on race, religion, disability, gender, sexual orientation, national origin, ethnicity, age, or any other protected or immutable characteristic.
  • Adult content or sexual services. Adult services, pornography, sexually explicit content, sexual gratification content, adult live chat, escort services, prostitution, fetish services, mail-order bride services, strip clubs, or any AI-generated or other content that falls within prohibited adult content categories.
  • Weapons, explosives, and dangerous materials. Illegal weapons, firearms or regulated weapons where restricted, weapon parts or accessories, explosives, dangerous materials, toxic, flammable, combustible, radioactive, or otherwise hazardous goods, or any campaign intended to fund, promote, or facilitate such items or activities.
  • Drugs, cannabis, CBD, tobacco, and related products. Illegal drugs, controlled substances, substances designed to mimic illegal drugs, cannabis or marijuana-related businesses, prohibited CBD products, drug paraphernalia, tobacco products, e-cigarettes, vaping products, or related production, cultivation, or distribution activities.
  • Gambling, raffles, lotteries, contests, and prize-based fundraising. Gambling, games of chance, lotteries, sweepstakes, raffles, fantasy sports, contests, auctions, bidding-fee auctions, prize-based promotions, or any campaign where a donation, entry fee, or payment creates a chance to win money, goods, services, or anything of value, unless expressly approved in writing by Donate and permitted by Stripe, applicable law, and all required regulators.
  • Financial products and regulated financial services. Money transmission, peer-to-peer money movement, cryptocurrency, NFTs, investment opportunities, lending, credit repair, debt relief, debt collection, escrow, stored value, gift cards, prepaid cards, banking, securities, insurance, or any other regulated financial product or service, unless expressly approved in writing by Donate and permitted by Stripe and applicable law.
  • Intellectual property infringement. Counterfeit goods, unauthorized use of copyrighted materials, trademarks, trade secrets, proprietary materials, images, names, logos, or other intellectual property, or any campaign or content that infringes or facilitates infringement of third-party rights.
  • Medical, pharmaceutical, or regulated health products and services. Online pharmacies, prescription-only products, regulated medical devices, telemedicine, unsafe pseudo-pharmaceuticals, nutraceuticals making harmful or unsupported claims, or any campaign involving medical products or services that require licenses, approvals, or regulatory compliance unless such activity is lawful, properly documented, and expressly approved by Donate.
  • Government services or unauthorized public services. Unauthorized government services, misleading claims related to government benefits or public services, disbursement of government funds without proper authorization, or resale of government services without authorization or added value.
  • Political fundraising where prohibited or unsupported. Political campaigns, lobbying, election-related fundraising, political organizations, or advocacy activities where such use is prohibited or restricted by Stripe, applicable law, or Donate’s eligibility standards, unless expressly approved in writing by Donate and permitted by Stripe and applicable law.
  • Personal fundraising or unsupported beneficiaries. Donations to individuals, personal causes, personal expenses, informal groups, or unverified beneficiaries, unless expressly approved by Donate and permitted by Stripe, applicable law, and our internal eligibility requirements.
  • Unsupported crowdfunding or restricted fundraising. Any crowdfunding, fundraising, nonprofit, charity, reward-based donation, equity crowdfunding, charity raffle, or similar activity that requires additional due diligence or approval by Stripe or Donate unless the organization, campaign, and transaction structure have been reviewed and approved by Donate and, where required, by Stripe.
  • Misuse of the platform or systems. Scraping, crawling, unauthorized data collection, malware, viruses, bots, attempts to bypass security, interference with the operation of the platform, excessive or suspicious transactions, card testing, unauthorized access, or any activity that may harm Donate, donors, partner organizations, payment processors, banking partners, or other users.
  • Any other prohibited or restricted activity. Any activity that Donate, Stripe, our payment processors, banking partners, card networks, regulators, or applicable law determine to be prohibited, restricted, high-risk, unlawful, deceptive, abusive, unsafe, or unsupported.

11.3 Restricted Activities and Additional Review

Some organizations, campaigns, activities, jurisdictions, or transaction types may not be prohibited but may require additional review, documentation, licenses, approvals, or written permission from Donate, Stripe, or another payment processor before they can be supported.

Donate may require partner organizations to provide documentation, including but not limited to proof of nonprofit status, government registration, tax-exempt status, charitable solicitation registration, organizational documents, authorized representative information, bank account information, campaign details, use-of-funds descriptions, licenses, permits, sanctions screening information, and any other materials needed for legal, compliance, payment processing, or risk review.

Approval by Donate does not guarantee approval by Stripe or any other payment processor. Donate may deny, pause, remove, or limit any organization, campaign, donation, or payout at any time if additional review is required or if support becomes unavailable.

11.4 Partner Organization Responsibilities

Partner organizations are responsible for ensuring that all information they submit to Donate is true, accurate, complete, current, and not misleading. Partner organizations must use donated funds only for the charitable purposes described in their approved profile, campaign, or agreement with Donate, and must comply with all applicable laws, tax rules, charitable solicitation rules, reporting obligations, donor restrictions, and payment processor requirements.

Partner organizations may not use Donate to fundraise for prohibited or restricted purposes, to misrepresent their programs or impact, to divert funds for unauthorized uses, or to act on behalf of another organization, person, or beneficiary without proper authorization and approval.

11.5 Monitoring and Enforcement

Donate may monitor activity on the platform, review organizations and campaigns, request additional information, investigate suspected violations, delay or block donations or payouts, remove content, suspend or terminate accounts, issue refunds, report activity to payment processors or authorities, and take any other action we consider necessary to protect donors, partner organizations, Donate, Stripe, payment processors, banking partners, and the integrity of the platform.

Violations of this Acceptable Use and Prohibited Uses Policy may result in immediate suspension or removal from Donate, cancellation of campaigns, withholding or refunding of donations where permitted or required, termination of access to the platform, and any other remedies available under these Terms or applicable law.

11.6 Updates to This Policy

Donate may update this Acceptable Use and Prohibited Uses Policy from time to time to reflect changes in law, Stripe requirements, payment processor rules, card network rules, our nonprofit eligibility standards, or our risk and compliance practices. Continued use of Donate after an update means you accept the revised policy.
